In India, when a cheque issued by a person is dishonoured or "bounced" due to insufficient funds or any other reason, the payee (the person to whom the cheque was issued) has the legal right to initiate action under Section 138 of the Negotiable Instruments Act, 1881. The first step in this process is sending a legal notice to the drawer (the person who issued the cheque). This notice must be sent within 30 days from the date of receiving the memo from the bank indicating the cheque has bounced. | |
